AsylverfahrenAsylum procedure

The procedure for granting the right of asylum in european and german asylum law is currently in the process of amendment in order to harmonize with the political situation.

You can get a general overview of the procedure for granting the right of asylum on the website of the Federal Office for Migration and Refugees (BAMF)

It is important that you get professional advice. Please find more details under „Legal advice“.

  • Where can I register as asylum seeker? Arrival and Registration

All asylum seekers in Germany have to register.

Immediately after arrival you will have to register at the official registration office. When entering the country, registration takes place through the border agency. If you are already in Germany, you can register at the aliens department, refugee accomdation or arrival centre.

  • Can I choose a city?

Refugees are distributed all over the country based on percentage. Bremen is taking 1% of arriving refugees. Therefore, it is not possible to choose a city.

In exceptional cases, a wish for a specific city based on personal reasons can be considered.

  • What is a residency permit?

A residency permit (Aufenthaltsgestattung) gives you legal right to be in Germany.

You will receive temporary residency permit, if you are registered in Germany and have applied for asylum but your asylum procedure hasn’t started yet. This permit is called “BÜMA”, (Bescheinigung über die Meldung als Asylsuchender = asylum seeker registration certificate) and you are required to carry it with you at all times. Depending on your personal status you will receive different residency permits. Please read carefully which kind of residency permit you have been given. Depending on the kind, you are allowed to travel through Germany or are restricted to the federal state where you registered, for example in Bremen. If you wish to travel to another federl state (e.g. Hamburg) you have to apply for a permit from the aliend department (Ausländerbehörde)

  • What do I have to expect from a hearing (Anhörung)?

The hearing is a personal interview which is important for your right of residence. This hearing is also important for your international protection.

At the hearing you will have to describe why you have left the home country. The hearing is very important and how well you do will have an impact on wether you will be granted asylum or not.

Therefore, it is very important that you prepare for the hearing in advance. You can contact this advice platform who provide professional advice on how to prepare for your hearing.

More information on your personal hearing is available here  BAMF.

  • What can I do if I don't get granted asylum?

In case of a negative reply to your aslym application you should react immediately. There are legal actions you can take but it is important to act fast as the eadline to appeal is very short. Find a lawyer who is specialised in Asylum and Immigration law or contact legal advice providers. It is possible that you will have to go to court to appeal against the decision.
